Welcome to Fynx. Please read these Terms of Service carefully before using our website or engaging our services. These terms govern your use of our platform and the professional relationship between you and Fynx.
1. Acceptance of Terms
By accessing or using the Fynx website (fynx.ae) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, clients, and others who access or use our services.
2. Services
Fynx provides digital marketing services including, but not limited to, web design and development, mobile app development, performance marketing (Google Ads, Meta Ads), social media management, SEO, branding, videography, and photography. The scope of services for each client is defined in a separate written agreement or proposal. Fynx reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3. Client Responsibilities
Clients are responsible for providing accurate and complete information necessary to deliver the agreed services. You agree to provide timely feedback, approvals, and any assets or access required for project completion. Delays caused by the client's failure to provide required materials may result in revised timelines and additional costs.
4. Payment Terms
Payment terms are outlined in individual proposals or service agreements. Unless otherwise agreed in writing, invoices are due within 7 days of issuance. Fynx reserves the right to pause or discontinue work on any project where payment is overdue. Late payments may incur additional charges. All prices are in AED unless otherwise stated.
5. Intellectual Property
Upon full payment, clients receive ownership of the final deliverables as specified in the project agreement. Fynx retains the right to use work completed for clients in its portfolio and marketing materials unless explicitly agreed otherwise in writing. Any third-party assets (stock images, fonts, plugins, etc.) used in a project remain subject to their respective licenses.
6. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. Fynx will not disclose client data, strategies, or business information to third parties without explicit written consent, except where required by law.
7. Limitation of Liability
Fynx shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability in connection with any project shall not exceed the total fees paid by the client for that specific project. Fynx does not guarantee specific results from marketing campaigns, as performance depends on many factors outside our control.
8. Termination
Either party may terminate a service agreement with 30 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. Fynx reserves the right to immediately terminate services in cases of non-payment, breach of these terms, or conduct deemed harmful to our team or reputation.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
10. Changes to Terms
Fynx reserves the right to update these Terms of Service at any time. Changes will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
